12A vs 80G: What's the Difference, and Does Your NGO Need Both?

If you've just registered a Trust, Society or Section 8 Company, you've probably already heard the terms 12A and 80G thrown around together — often as if they're the same certificate. They're not, and understanding the difference matters, because they protect two different people.

12A Registration: Protects Your NGO's Own Income

Section 12A of the Income Tax Act exempts your NGO's own income from tax, provided that income is applied towards your charitable objects. Without 12A, your organisation's surplus — donations, grants, or any income — is technically taxable like a regular entity's income. 12A is almost always the first registration a new NGO should apply for.

80G Registration: Protects Your Donors

Section 80G works differently — it doesn't exempt your NGO's income at all. Instead, it allows the people who donate to you to claim a deduction on their own personal or corporate income tax. In practice, this is often the deciding factor for a donor choosing between two NGOs: contributing to an 80G-certified organisation reduces their own tax bill, while contributing to one without it doesn't.

So Does Your NGO Need Both?

In almost every case, yes. 12A protects your organisation; 80G protects your donors and, indirectly, your fundraising ability. Most NGOs apply for both together as a starting package, since the documentation required overlaps significantly and filing them together is more efficient than filing separately at different times.

What You'll Need

Both applications require your NGO's PAN, registration certificate and trust deed / MOA-AOA / bye-laws, PAN and Aadhaar of your trustees or governing body, and address proof of your registered office. Approval timelines are similar for both, typically in the 15–20 working day range depending on the department's current processing load.
